The Backpacker Hub Ltd Terms of Business.

Please review the following Terms of Business (“Terms and Conditions”) carefully and ensure you agree to them before completing a Booking with Us.

Every Booking made on Our website is subject to these Terms. By proceeding with a Booking, You acknowledge that You accept these Terms and agree to enter into a legally binding Agreement with Us. If You do not agree to these Terms, please refrain from making a Booking.

Definition of Terms:

Participant:  Means anyone who participates in one of our Tours or activities.
Lead booker:  Means the 1st named person on the booking arrangements.
Website:  Our website and any associated sub-domain.
Tour:  Means the Tours and Packages that The Backpacker Hub Ltd organise and you book through us.  
Fee:  Means the price paid for the Tour by all Participants or Travellers.
Terms:  The Terms and Conditions relating to your Booking with us.
Conformation email:  The email from us which confirms your Booking, and at which point a contract for services is formed.  
Claim:  Any claim that is made in respect of your Tour.
Third Party:  Any external service provider such as airline, hotel, transportation.
Law:The applicable Law which regulates these terms & Conditions.

These Booking Conditions, alongside our Privacy Policy, Website Terms of Use, and any additional written information provided to you prior to confirming your booking, form the basis of your contract with The Backpacker Hub Ltd.

The Backpacker Hub Limited (“Us”, “Our”, “we”, “Company”) is a Company registered in England & Wales, and who’s Registered Office is located at 34 Templeton Drive, Fearnhead, Warrington, WA2 0WR, United Kingdom, under Company Number 15997193. These Booking Terms and Conditions outline the rights and responsibilities of both Parties and form the basis of the Contract for Services between you as a Consumer and us.

By completing a booking with us, the first named person on the booking (“you” or “your”) confirms on behalf of all individuals included in the booking that:

1.1. You have read and understood these Booking Conditions and agree to be legally bound by them.

1.2. You consent to our use of personal data in accordance with our Privacy & Data Handling Policy and confirm you are authorised to provide personal details, including any sensitive information such as health conditions or dietary requirements, for all individuals included in the booking.

1.3. We will accept advance bookings from Participants who are less than 18 years at the time of booking, as long as they have their parent’s or Guardian’s consent to do so at the time of such booking being made, and on proviso the Participant/s will have attained the age of 18 years old when the tour commences.

1.4. You accept full financial responsibility for the payment of the booking on behalf of all individuals included on the booking.

1.5. All participants are required to sign our waiver before the tour. Failure to sign the waiver will result in the cancellation of the tour, with no refund issued.

2.1. Your booking is only confirmed when we receive the specified deposit payment, and you are issued a confirmation email from us. Until this confirmation is sent, all bookings remain subject to availability. We reserve the right to decline your booking at our sole discretion, in which case your initial payment will be refunded to you.

2.2. To secure your booking, a non refundable deposit amounting to 20% of the total cost (or another amount as specified at the time of booking) is required. The remaining balance must be paid in full no later than 75 days prior to the tour’s start date. If we do not receive the balance within this timeframe, we reserve the right to treat your booking as cancelled, with no refund of the deposit.

2.3. If you book more than one tour at the same time as part of your travel itinerary, you will have to pay more than one deposit, a deposit is needed per programme.

2.4. Any fees or charges incurred using card payments as a result of international transactions shall be solely the responsibility of the customer.

2.5. The individual named as the lead booker is responsible for ensuring the accuracy of all details provided on behalf of themselves and any other participants included in the booking. The lead booker is responsible and must confirm that all participants understand and accept these Terms.

3.1. Securing adequate travel insurance is a fundamental requirement of your contract with us. You understand your insurance policy must comprehensively cover your personal requirements and the specific itinerary of your chosen tour.

3.2. It is your sole responsibility to arrange a valid insurance policy and ensure it remains active for the entire duration of your tour. All participants are required to have personal travel insurance. You acknowledge that The Backpacker Hub Ltd is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially or otherwise.

You may wish to consider:

  • Pre-existing medical conditions;
  • Medical and emergency expenses;
  • Tour cancellations and interruptions;
  • Travel disruptions, including delays or restrictions due to Foreign, Commonwealth & Development Office (FCDO) advisories;
  • Repatriation in cases of illness, injury, pandemic, epidemic, terrorism, natural disasters, or other unforeseen circumstances.

3.3. We strongly recommend obtaining travel insurance at the time of booking to ensure you are protected against unforeseen events that may arise before your departure.

3.4. If you choose to travel without a valid insurance policy, you do so at your own risk. The Backpacker Hub Ltd accepts no responsibility for any financial, medical, or personal losses that may occur, including those that could have been mitigated by suitable insurance coverage.

3.5 The Backpacker Hub Ltd is not responsible for any injury, loss, or damage during the tour.

3.6. If you fail to obtain travel insurance, your tour will be cancelled with no refund issued.

3.7. Please note that private health insurance policies in your home country may not provide adequate international or activity-specific coverage. It is essential to confirm with your provider that your chosen policy meets the necessary requirements for your tour.

4.1. All prices for our products, services, and programmes are listed in pounds sterling (£). Prices are per person and include accommodation, transport and activities, as detailed in the itinerary or product description.

4.2. We reserve the right to adjust the price of unsold programmes and products at any time. Additionally, for confirmed bookings, we reserve the right to adjust prices in response to changes beyond our control, such as:

  1. Increases in the cost of transportation, including fuel or other energy sources;
  2. New or increased taxes or fees imposed by third parties, such as tourist taxes, airport charges, or port fees; and
  3. Fluctuations in exchange rates relevant to your booking.

4.3. We make every effort to ensure the accuracy of all information and pricing displayed on our website and in any promotional materials we produce. However, occasional errors or changes may occur. In such cases, we reserve the right to amend prices and other details as necessary. It is your responsibility to verify the most up-to-date pricing and all relevant details concerning your intended booking prior to finalising your reservation.

5.1. If the deposit or remaining balance is not paid by the specified due date, it will be considered a cancellation of your booking.

5.2. Cancellations made more than 75 days before the tour departure date will qualify for full refund, minus the deposit. In the event of prohibitions such as close bereavement or medical emergency, we may make an exception at our sole discretion. We recommend that you hold sufficient Travel Insurance to cover such emergencies.

5.3. Cancellations made between 74-60 days before the tour departure date will qualify for a 50% refund, minus the deposit.

5.4. Cancellations made less than 60 days before the tour departure date will not be entitled to a refund.

5.5. In the situation you or a member of your booking are prevented from travelling, that person may transfer their place to someone else under the conditions that person is introduced by you, we are notified more than 20 days to the tour departure date and the transferee agrees to these booking conditions and all other terms of the contract between us.

5.6. If you or another member of your booking decides to submit a cancellation request, this must be submitted in writing to info@Thebackpackerhub.co.uk. Your notice of cancellation will only come into effect when it is received by us and will be effective from the date we received it. Please allow up to 5 business days for the acknowledgment.

You should include:

  • Participant’s full name
  • Booking reference
  • Tour details

5.7. If you leave your tour before the end for any reason we will not be liable for any refund of the unused portion.

5.8.1 As we plan our tours months in advance we may occasionally have to make changes to the itinerary or cancel your booking and we reserve the right to do so at any time. If we make a change to your tour, we will communicate these to you as soon as reasonably possible and will use our best endeavours to ensure that any changes result in being of an equivalent or higher quality, but we will have no further liability to you.

5.9. We will not cancel your tour less than 30 days before your tour departure date, except for reasons of force majeure or failure by you to pay the final balance. Additionally, our Tours may be subject to a minimum number of participants in order to proceed. If this minimum is not reached, then we reserve the right to cancel that tour.

5.10. If for any reason we have to cancel or change the Start Date of any Tour, for any reason whatsoever, You will have three (3) options.

  • Swap to a different tour.
  • Change to a different date.
  • Request a refund.

5.10.1 If any Tour featuring an Influencer or Content Creator is unable to attend a tour as originally advertised, the tour will continue as scheduled but with a substitute guide. In this case, the tour is considered to be proceeding as planned, and no refunds, date changes, or trip swaps will be offered based solely on the Influencer’s non-attendance.

5.11 In the circumstance we believe your behaviour may negatively impact our reputation, suppliers, or their property, we may decline your booking and you will only be offered a refund of any deposit or price paid.

5.12. The Backpacker Hub Ltd shall not be liable or responsible for any of your expenses incurred in preparation for any cancelled tour such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your tour.

6.1. The Backpacker Hub Ltd will not be liable or responsible to pay you compensation if our contractual obligations to you are affected by Force Majeure, this means any circumstances that are beyond our control or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. (E.g. Acts of terrorism, Strikes, pandemics, transportation failures, warfare, political instability, civil war (whether declared or not), government restrictions, strikes and natural disasters such as floods and earthquakes).

6.2  If you have booked your arrangements as part of an overall package from us, we state that we will comply with any required refund or rebooking obligations under the Package Travel Regulations in any Force Majeure situations. We will offer you either:

6.2.1 a full refund: if the Tour package cannot be delivered due to such events, you are entitled to a full refund within 14 days.

6.2.2 alternative arrangements: The Backpacker Hub Ltd will offer credit to the equivalent value of the Tour package which will be valid for 18 months. It is your decision to accept this or opt for refund.

7.1. Our responsibility to you is to provide you with the services that you have booked with us, whether provided by The Backpacker Hub Ltd directly, or our overseas suppliers and subcontractors. We coordinate with overseas suppliers and subcontractors to the best of our abilities to ensure that the information we give you is correct.

7.2. We check the information that we provide to you carefully, but things can change and any errors or omissions are inadvertent and we cannot be held responsible for them, other than to refund you for any services which you have not received as a direct result of our negligence. We cannot be held responsible for changes made to your tour as a result of weather, political or terrorist threats or other events beyond our control.

7.3. We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claims of any description if it results from:

  • the acts and/or omissions of the person affected; or
  • the acts and/or omissions of a third party unconnected with the provision of the services contracted for and which were unavoidable and extraordinary; or
  • Force Majeure (as defined in clause 6).

7.4. During our tours, you may be offered the opportunity to engage in optional activities or excursions that are not included in the cost of your tour. The Backpacker Hub Ltd does not own, manage, or control any external companies or individuals that provide these optional activities or excursions. You assume full responsibility for any risks associated with transportation to and from, as well as your participation in, or visits to, any location, activity, or excursion that is not explicitly included in your programme.

7.5 Any support provided by The Backpacker Hub team or our on-the-ground partners in arranging, recommending, or booking such optional activities is done solely at your request. We make no guarantees and expressly disclaim all liability arising from your participation in these activities.

7.6 By choosing to participate in any optional activities or excursions, you acknowledge and accept that The Backpacker Hub Ltd does not accept any responsibility or liability for any loss, damage, personal injury, death, illness, emotional distress, mental suffering, psychological harm, or property damage arising from or in connection with such activities. Responsibility for these activities rests solely with the independent third-party providers.

7.6.1 Optional activities that are not included in our Immediate Tour itinerary form no part of your contract with us. Any information, assistance, or recommendations provided by our group leaders, representatives, or staff regarding such optional activities are offered purely as a courtesy and do not constitute an endorsement or acceptance of liability.

7.6.2 Participation in optional activities is subject to the terms and conditions of the third-party provider, and any contract for such activities is exclusively between you and the relevant provider. We are not a party to any such contracts and disclaim all liability arising from participation in optional activities.

7.6.3 Nothing in this clause limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded under applicable law.

7.7 It is your responsibility to ensure that any optional activities or excursions you book outside your agreed and booked programme are facilitated by reputable providers and that your travel insurance adequately covers you for any additional activities.

7.8. Participants are solely responsible for ensuring they possess all necessary travel documents, including but not limited to a valid passport and applicable visas. It is your responsibility to check and fulfil the passport, visa, health and immigration requirements applicable to your itinerary.  We can only provide general guidance on this matter. It is your responsibility to verify the requirements specific to your circumstances with the appropriate Embassies, Consulates, and, where applicable, your healthcare provider. Please note that requirements are subject to change, and you must ensure you have the most up-to-date information well in advance of your departure. The Backpacker Hub Ltd will not be held liable for any delays, disruptions, or cancellations resulting from insufficient or invalid documentation.

8.1 You agree to abide by The Backpacker Hub terms and conditions.

8.2 By participating in a tour with The Backpacker Hub Ltd, you agree to abide by all applicable laws, regulations, and cultural norms of the destination(s) you visit. This includes, but is not limited to, compliance with regulations regarding drugs, alcohol, and local social conventions.

8.3 Engaging in illegal activities or displaying behaviour deemed seriously inappropriate by our local coordinator—whether it disrupts the tour’s smooth operation or compromises the safety or enjoyment of other participants—will result in a formal warning. If this warning is disregarded, or if the initial conduct is sufficiently severe, The Backpacker Hub Ltd reserves the right to remove you from the tour. In such cases, no refunds will be provided, and we will not be held liable for any travel arrangements required for your return home. Additionally, we reserve the right to recover from you any expenses incurred as a direct result of your actions.

8.4 Guests are hereby advised to consume alcohol responsibly and to avoid excessive consumption, particularly in advance of any scheduled activities. Any level of intoxication that poses a risk to the safety or well-being of the individual, other participants, or the activity itself shall be deemed unacceptable. In such circumstances, The Backpacker Hub Ltd reserves the right, at its sole discretion, to exclude the guest from the activity without any entitlement to a refund or compensation. The same conditions apply to the prohibition of recreational drug use whilst on our Tours.

8.5 Participants are responsible for adhering to the instructions and guidance provided by our guides and suppliers during any organised activities to ensure their own safety and the safety of others.

8.6 During periods of free time or self-planned activities, guests assume full responsibility for their own safety and well-being. The Backpacker Hub Ltd strongly encourages participants to follow all safety advice and warnings issued by our team or local authorities. If a guest elects to ignore these recommendations, The Backpacker Hub Ltd accepts no liability for any harm, loss, or incidents that may result from such actions.

8.7 Any damages caused by guests through by negligence or intentional acts, must be compensated by the individual responsible. The Participant will be held liable for covering the full cost of repair or replacement for any damage incurred.

8.8 Please be aware that flights to and from your destination are not included in the cost of our packages at The Backpacker Hub Ltd. It is the responsibility of each traveller to arrange their own flights prior to the tour start date. Deposits are non-refundable for those who book a package assuming that flights are included.

8.9 We strongly recommend that all travellers purchase travel insurance before booking onto a tour or booking flights for a tour.

8.10 Travel insurance helps protect you financially in the event of a cancellation by The Backpacker Hub Ltd or unforeseen circumstances.

9.1. The Backpacker Hub Ltd. cannot be held responsible for any additional expenses incurred due to COVID-19, SARS or other similar viruses and any impact on your tour. At the time of your tour’s departure, it may be a mandatory requirement to present a negative COVID-19 or SARS test or proof of COVID-19 vaccination to gain entry.

10.1. By accepting our terms and conditions, you consent to any photos or videos shared with us through any medium (such as WhatsApp group chats or Google Photos) being used across our website, social media channels (including but not limited to Facebook, Instagram, Twitter, and LinkedIn), marketing materials, brochures, newsletters, advertisements, and other promotional or informational content. We reserve the right to use these photos or videos indefinitely unless you provide written notice to opt out. You may withdraw your consent at any time by submitting a written request. However, any use of media prior to the withdrawal of consent will remain valid.

11.1. Only meals stated in the itinerary will be included.

11.2. Meals may require Pre-ordering by the lead traveller, and we will not be responsible for any issues regarding your order where the lead traveller has incorrectly placed the pre-order.

11.3 The Backpacker Hub Ltd is not responsible for any illnesses that may arise from consuming local food or meals provided by suppliers. It is your responsibility to be mindful of any dietary restrictions, allergies, or food sensitivities and to take necessary precautions before and during your tour. If you have any particular food allergy or special dietary needs, you should inform us at the time of your booking. We will aim to relay this information to the relevant Supplier. However, we cannot guarantee that this will be confirmed and you are advised to make such information known in person with the appropriate Supplier or prior to any meal preparation.

12.1. By accepting our terms and conditions, you consent to The Backpacker Hub Ltd sharing your information with trusted third parties as necessary. This may include, but is not limited to, service providers such as hotels, transportation providers, activities, and hotels.

12.2. By purchasing a tour or accepting our terms and conditions, you will be given the opportunity to be added to being added to our mailing list and we will obtain your express consent to receiving marketing information. This will include updates, newsletters, promotions, special offers and other relevant communications from The Backpacker Hub Ltd. You can unsubscribe from the mailing list at any time by following the instructions in the emails or contacting us directly. We do not share your details with any other third party for marketing purposes.

13.1. The Backpacker Hub Ltd reserves the right to confirm accommodation details only after full payment has been received.

13.2. Guests will be required to share rooms and facilities with other participants. Room assignments will consist of either twin or double beds and are subject to availability, which may vary by tour. We will do our best to accommodate preferences where possible, but specific room types or bed arrangements cannot be guaranteed.

13.3. Guests will be randomly paired with fellow participants for allocation. This can mean that opposite sexes can become roommates for the duration of the tour. We aim to create a comfortable and friendly atmosphere, we will do our best to accommodate any special requests when possible. This approach helps us maintain our budget-friendly pricing and keep a sense of community throughout the tour. If you have any concerns regarding mixed sex accommodation, or If travelling as a group or pair, please make us aware at the soonest possible chance and we will take this into account when allocating rooms but this cannot be guaranteed.

14.1. By purchasing any digital products, including maps and travel guides, from The Backpacker Hub Ltd, you agree to the following terms:

14.1.1 Usage Rights: Digital products are for personal use only. You may not distribute, share, or resell any digital content purchased from us.

14.1.2 Delivery: Digital products will be delivered electronically to the email address provided during purchase. It is your responsibility to provide a valid email address.

14.1.3 Refund Policy: Due to the nature of digital products, all sales are final. Refunds will not be issued once the product has been downloaded or accessed. These are Digital Downloads and as such are excluded from the Consumer Contract Regulations. By downloading you Are waiving your right to the 14 day statutory “cooling off” period.

14.1.4 Intellectual Property: All digital products are copyrighted and remain the intellectual property of The Backpacker Hub Ltd. Unauthorised reproduction or distribution is strictly prohibited.

14.1.5 Accuracy of Information: While we strive to ensure all maps and guides are accurate and up-to-date, The Backpacker Hub Ltd is not responsible for any errors, omissions, or changes in conditions at destinations mentioned in the digital products.

14.1.6 Technical Issues: If you encounter any issues with downloading or accessing your digital product, please contact us within 7 days of purchase for assistance.

14.1.7 By Purchasing a digital product you can give us your express consent to be added to our mailing list for future promotions (see also 12.2).

14.1.8 By purchasing a digital product, you acknowledge and agree to these terms and conditions 14.1.1 – 14.1.8.

15.1. Your enjoyment of the Tour is our prime concern at all times. However, if you have any cause for concern or are unhappy with any element of the Tour, we would ask you first to bring this to the attention of the person in charge of the relevant service, whilst the activity or event in question is taking place. If you have any issues with the services we provide to you, please email (info@thebackpackerhub.com) outlining your concern.

15.2 We will do our best to resolve the issue fairly. You must give us an opportunity to fix any problem when it happens. You should contact us within 48 hours of any difficulty, if you would like us to take any action.

15.3 In case of a formal complaint being made, we do not accept any complaints by an individual, or individuals which purport to be on behalf of more than one person in the group. We require any complaints from all individuals to be raised on an individual basis.

15.4 All complaints are handled in accordance with Our complaints handling policy and procedure. We commit to addressing disputes or complaints in good faith, and in line with recognised alternative dispute resolution (ADR) procedures.

15.5 If the complaint is not resolved satisfactorily within 14 days, you may escalate the matter to a Director of The Company via our Registered Office, who shall respond within 7 days.

15.6  If you remain unsatisfied by their decision, then you can request the appointment of an Independent Arbitrator, who shall be appointed by the then current President of The Chartered Institute of Arbitrators of 12 Bloomsbury Square, London. If you choose this route of Arbitration, you agree that the Arbitrator’s decision shall be regarded as being final. The cost of the arbitration shall be born by both Parties equally.

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be severed from the remaining Terms and Conditions. The remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

16.2 In the event that severance materially alters the scope or intention of these Terms and Conditions, the parties agree to negotiate in good faith to amend the affected provisions to reflect the original intent as closely as possible, while remaining compliant with applicable laws.

17.1. We may revise these Terms of Business from time to time in response to changes in relevant laws and other regulatory requirements. If We change these Terms of Business as they relate to your booking, We will give you reasonable advance notice of the changes and provide details of how to cancel if you are not happy to accept them.

18.1 These Terms of Sale, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with the Laws of England & Wales.

18.2 If you are a Consumer, any disputes concerning these Terms of Sale, the relationship between you and Us, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the jurisdiction of the Courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.

18.3 If you are a business, any disputes concerning these Terms of Sale, the relationship between you and Us, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

A.  We may partner with Social Media Influencers, Content Creators and Collaborators (“Influencer”) to promote our tours. Participants of our tours may have the opportunity to travel alongside these Influencers.

B. Tours featuring Influencers or Content Creators acting as a Group Leader alongside a Local Guide, may be subject to a minimum number of participants in order to proceed. If this minimum is not reached, then we reserve the right to cancel that tour. In the event of the non-availability of the specified Influencer/ Content Creator, the tour would still go ahead, under the supervision of one of our regular Group leaders. In this case, the tour is considered to be proceeding as planned, and no refunds, date changes, or trip swaps will be offered based solely on the Influencer’s non-attendance. No refunds or compensation for any perceived loss will be provided due to the absence or expected presence of the Influencer.

C. Tours featuring Influencers or Creators may be subject to a minimum number of participants. If this minimum is not reached, then we reserve the right to cancel that tour. Participants will be notified of any cancellation at least 30 days prior to the scheduled departure.

D. If we are required for any reason to cancel an Influencer tour, Participants will receive a full refund of any payments made directly to The Backpacker Hub for that specific tour.
